Agreement to these terms
By using forethekidskc.org, donating through this site, registering for an event, or contacting us through this site, you agree to these terms. If you do not agree with them, please do not use the site.
Who we are
Fore the Kids Foundation is a 501(c)(3) nonprofit organization based in Overland Park, Kansas. We raise money through local events, corporate sponsorships, and individual giving, and we direct that money to youth mental health projects at Children's Mercy and other partner organizations across the Kansas City region.
In these terms, "we," "us," and "our" mean Fore the Kids Foundation. "You" means anyone using this site.
What this site is, and what it is not
This site exists to explain what we fund, promote our events, and accept donations. It is an informational and fundraising site.
We are a fundraising organization, not a healthcare provider. We do not diagnose, treat, or provide mental health care. Any resources, program descriptions, or general information about mental health on this site are provided for reference only. They are not medical advice and are not a substitute for care from a qualified professional. Reading this site does not create a patient, client, or provider relationship of any kind.
If you or someone you know is in crisis, do not rely on this website. Call or text 988 to reach the Suicide and Crisis Lifeline, available 24 hours a day, free and confidential. In an emergency, call 911 or go to your nearest emergency room.
Donations
Donations made through this site are processed by our third-party donation platform. By donating, you agree to that platform's terms in addition to these.
- Tax deductibility. Fore the Kids Foundation is a registered 501(c)(3) organization, and donations are tax deductible to the extent allowed by law. You will receive a receipt for your gift. We do not provide tax advice, so consult your own advisor about your specific situation.
- Event tickets and purchases. When you buy a ticket, bid on an auction item, or purchase merchandise, only the amount above the fair market value of what you receive is generally tax deductible. Event materials will indicate this where applicable.
- Recurring gifts. Monthly gifts continue until you cancel. You can pause or cancel at any time by contacting us, and we will process the change promptly.
- Refunds. Donations are generally final. If you made a gift in error, made a duplicate gift, or entered an incorrect amount, contact us right away and we will work with you in good faith to correct it.
- Designations. We honor donor intent wherever possible. If a project you designated is fully funded, completed, or discontinued, we will apply your gift to a comparable project consistent with our mission.
Events, tickets, and auctions
Registration, ticketing, sponsorship purchases, raffle entries, and auction bidding for our events are handled through a third-party event platform. Each event has its own terms, pricing, and deadlines, which are provided at the point of purchase.
- Tickets. Unless an event's own terms say otherwise, tickets are non-refundable. Tickets are generally transferable to another guest. Contact us if you need to transfer one.
- Cancellation and weather. Outdoor events may be delayed, shortened, moved, or canceled for weather or safety. If an event is canceled outright, we will communicate options to registered guests.
- Auctions. All bids are binding. Winning bidders are responsible for payment and for arranging pickup or delivery of the item. Items are provided as described by the donor, and we make no warranty about them beyond that description. Auction items and experiences may carry their own restrictions or expiration dates.
- Raffles. Raffles are conducted in accordance with applicable Kansas law. Each raffle has its own official rules, including entry deadlines, drawing details, and eligibility, which are published with that raffle. You do not need to attend an event to enter or win unless a specific raffle's rules state otherwise.
- Age requirements. Some of our events serve alcohol. Guests at those events must be 21 or older, and valid identification may be required.
- Conduct at events. We reserve the right to remove any guest whose behavior is unsafe, disruptive, or harmful to others, without a refund.
Photography and video at events
We photograph and record our events. By attending, you understand that you may appear in photos or video, and you grant Fore the Kids Foundation permission to use that footage in our materials, on this site, in press coverage, and on social media, without compensation. If you would prefer not to be included, let event staff know and we will do our best to accommodate you.
Sponsorships
Sponsorship levels, benefits, and recognition vary by event and are set out in the materials for that event. A sponsorship is confirmed when payment is received and any applicable agreement is signed. Logo placement and recognition are provided as described in those materials. Sponsors are responsible for supplying usable logo files by the stated deadline, and we cannot guarantee placement for materials received after a print or production deadline has passed.
Volunteers
Volunteer opportunities are offered at our discretion. Submitting interest does not guarantee a role. Volunteers act on behalf of Fore the Kids only within the scope of the role assigned to them, and are expected to follow any instructions and conduct standards provided for the event.
Acceptable use
When using this site, you agree not to:
- Use it for any unlawful purpose or in violation of any applicable law
- Submit false, misleading, or fraudulent information, including fraudulent payment information
- Attempt to gain unauthorized access to the site, its systems, or any related platform
- Interfere with the operation of the site, introduce malicious code, or attempt to disrupt service
- Scrape, harvest, or collect information about our donors, sponsors, board members, or staff
- Impersonate Fore the Kids Foundation or claim to solicit donations on our behalf without written authorization
- Use our name, logo, or materials in a way that suggests endorsement or partnership we have not agreed to
Our content
The content on this site, including text, photographs, graphics, the Fore the Kids Foundation name, and our logos and marks, belongs to Fore the Kids Foundation or is used with permission. You may share and link to our pages, and press may use materials we make available for coverage of our work.
You may not reproduce our content for commercial purposes, sell it, or modify it and present it as your own without written permission. Logos and names of Children's Mercy and our partner organizations belong to those organizations and may not be used without their permission.
What you send us
When you send us a message, photo, or other content through this site, you confirm that you have the right to send it and you give us permission to use it in connection with our work. Do not send us confidential health information about yourself or anyone else through this site.
Third-party sites and platforms
This site links to and relies on services we do not control, including our donation platform, our event ticketing platform, our site host, and the websites of Children's Mercy and our partner organizations. We are not responsible for the content, availability, security, or practices of those services. Your use of them is governed by their own terms and privacy policies.
No warranties
This site is provided on an as-is and as-available basis. We work to keep information accurate and current, but we do not warrant that the site will be uninterrupted, error free, or free of harmful components, or that every detail on it is complete and up to date. Program details, funding figures, and event information are accurate as of the date published and may change.
Limitation of liability
To the fullest extent permitted by law, Fore the Kids Foundation and its board members, staff, and volunteers are not liable for any indirect, incidental, or consequential damages arising from your use of this site or from your reliance on information found here. Nothing in these terms limits any liability that cannot be limited under applicable law.
Indemnification
You agree to hold Fore the Kids Foundation harmless from any claim or demand arising out of your misuse of this site, your violation of these terms, or your violation of the rights of another party.
Governing law
These terms are governed by the laws of the State of Kansas, without regard to its conflict of laws rules. Any dispute arising from these terms or your use of this site will be brought in the state or federal courts located in Johnson County, Kansas.
Changes to these terms
We may update these terms as our site, events, or legal obligations change. When we do, we will revise the effective date at the top of this page. Continuing to use the site after a change means you accept the updated terms.
